GLOBAL SIM CARDS LIMITED - TERMS AND CONDITIONS

Introduction

These Terms and Conditions constitute a legally binding agreement ("Agreement") between you (the "User") and Global SIM Cards, a private limited company incorporated and registered in Hong Kong with company registration number 77940338 and having its registered office at 2/F., Tern Centre, Tower 1, 237 Queen's Road Central, Hong Kong. ("Global SIM Cards Limited," "we" or "us"), concerning your purchase of an international data plan ("Data Plan") relating to a prepaid SIM (an "eSIM" or “Physical Sim”), for use on your personal device ("Device").

Future agreements may be subject to supplemental terms posted on our website or app (the "Application").

We recommend printing a copy of these Terms and Conditions for future reference.

Registration

You may register to purchase an eSIM or Physical Sim through our Application. Registration requires acceptance of our Terms of Use, Privacy Policy, and Cookies Policy, which are displayed on the Application.

Purchase of a SIM and Activation

  • When you purchase a SIM from us via the Application, you agree to all charges based on the selected Data Plan.
  • You are responsible for the SIM once delivered. If lost or damaged, full payment is still required.
  • If you buy a SIM from a third party, you are entering into an agreement with that party—not with Global SIM Cards Limited.
  • We offer country- or region-specific Data Plans, which may be restricted in certain jurisdictions.
  • To use the SIM, your device must be unlocked and SIM-compatible.

Duration and Termination

  • This Agreement begins upon SIM purchase and continues until the Data Plan is consumed or expired.
  • The SIM will remain on your device even after the Data Plan expires, unless you choose to remove it manually.
  • Termination occurs upon Data Plan consumption or breach of Terms, which may result in service suspension.
  • After termination, the SIM is provided "as is" and without warranty unless you purchase a new Data Plan.

Warranty

  • These Terms are in addition to your statutory consumer rights.
  • We provide no warranties, expressed or implied, regarding the SIM or Service, except where required by law.
  • We reserve the right to discontinue any SIM sale or service at any time.

Service Availability

  • We strive to keep the Service available, subject to our and our partners’ network capacity.
  • Partners and providers vary by region.
  • “Unlimited” plans may be subject to fair use policies which may throttle speed or limit data use.
  • We do not guarantee service quality, including during maintenance, in poor coverage areas, or due to external disruptions like weather or interference.

User Obligations

  • Use the SIM legally and in accordance with our Terms.
  • Do not engage in fraud, misuse, or any activity that harms the network or breaches intellectual property rights.
  • Do not use the SIM to store or distribute our commercial or proprietary information without permission.
  • Promotions may not be abused through fake registrations or accounts.
  • We may suspend service for violations and pursue legal remedies.
  • We reserve the right to delete accounts or restrict future use in case of violations.

Payment Terms

  • SIMs can be purchased via the Application with payment handled by an authorized agent.
  • All SIMs are prepaid and include Indirect Tax unless otherwise noted.
  • Taxes are based on the shipping postcode entered during checkout.
  • You may save a payment method for future use, which can be deleted but not modified.

Legal Right of Withdrawal

  • Consumers may withdraw from the agreement within 14 days of SIM purchase or activation (whichever comes first).
  • Shipping costs are non-refundable once a Physical SIM has been posted.
  • To withdraw, contact Customer Support using the details in section 18.

Refund and Returns Policy

  • We aim to deliver a Service that complies with our Terms. If not, we may issue a refund.
  • To be eligible for a full refund:
    • The SIM must be purchased via our Application.
    • The SIM must not be activated.
    • The purchase must have occurred within 6 months of the refund request.
  • Partial refunds may be issued for:
    • Activated or partially used SIMs.
    • Network infrastructure issues in destination countries.
  • Incompatible or locked devices may qualify for full refund if other conditions are met.

Intellectual Property Rights

  • All SIMs, website content, and trademarks are the property of Global SIM Cards Limited or its licensors.
  • No content may be reused or distributed without our prior written consent.

Data Protection

  • We process personal data to deliver, monitor, and protect the Service.
  • Details are available in our Privacy Policy and Cookies Policy.

Indemnity

You agree to indemnify Global SIM Cards Limited and its affiliates for any loss or liability arising from your breach of these Terms or misuse of the Service.

Limitation of Liability

We are not liable for indirect or consequential damages. Total liability is capped at the amount you paid in the past 12 months under your Data Plan or $100 USD—whichever is greater—unless otherwise required by law.

Governing Law and Legal Compliance

  • This Agreement is governed by Hong Kong law and disputes are subject to Hong Kong courts, except where other mandatory laws apply.
  • Use of the Service must comply with local laws in your location.

Variation of Terms and Conditions

  • We may update these Terms. Changes will be posted on our Application with prior notice.
  • You may stop using the Service if you do not accept the changes.
  • Continuing to use the Service after changes indicates your acceptance.

General

  • We may transfer this Agreement to another company in our group without needing your permission.
  • If part of this Agreement is invalid but can be made valid by modification, it shall be enforced as modified.
  • Delays or omissions in exercising rights do not constitute a waiver.
  • This Agreement is drafted in English and shall prevail in the case of translation discrepancies.
